U.S. District Judge Leonie Brinkema has ruled that the prosecution in the Zacarias Moussaoui case can still seek the death penalty in the penalty phase of the trial.
Yesterday, Brinkema adjourned the trial after learning that prosecution witnesses were given the testimony of previous witnesses in preparation of their testimony.
The judge ruled that no testimony about aviation security measures will be allowed during the trial.
Moussaoui is the only person the government has arrested in connection with the September 11 terrorist attacks on the United States. He has admitted to being a member of the al-Qaeda terrorist network which carried out the attacks.
The jury now must decide whether to sentence Moussaoui to life in prison or sentence him to death.
