Defense Motion to Dismiss Charges Against Jackson Denied


There were no surprises today at the Michael Jackson child molestation case. The prosecution rested its case and as expected, Jackson's attorneys made a motion to have the charges against the pop singer dismissed due to what they said was the prosecution's failure to make out a case against Jackson.

Motions to dismiss are made in almost every criminal case at this point in the trial but they are almost never successful. Therefore, it was no surprise when Judge Rodney S. Melville denied the motion and directed the defense to begin calling its witnesses and presenting its case.

After 10 weeks of hearing from prosecutors witnesses, the jury will now hear from witnesses called by the defense. Jackson's attorneys are expected to lead with three people who prosecutors allege were molested by Jackson who will testify that the singer never did anything improper to them. One of those opening witnesses may be actor Macaulay Culkin.

Jackson is accused of molesting a then 13-year-old boy who was suffering from cancer. He has also been charged with serving alcohol to the boy and showing him pornography in both magazines and on the Internet. Jackson also faces charges that he attempted to keep the boy's family at the Neverland ranch. Prosecutors alleged Jackson and his employees used threats and intimidation to force the boy's family to make a rebuttal video for him after the airing of 'Living With Michael Jackson,' a documentary which harmed the pop star's reputation. Jackson faces as many as 20 years in prison if convicted. He denies all charges.
